doc type?

I tried to validate my site with validator.w3.org, but it says I need to
include a doc type. I knew it would say this but i've had problems with
adding the doctype. I have a menu on my page that is the scrolling type,
where when you scroll down, the menu scrolls down too. When I add a doc
type like 4.01 strict, or transitional, my scrolling menu becomes static.
Any idea why this happens? or how to get around it? The menu is DHTML

You are probably experiencing your browser switching to Standards Mode and
treating HTML and CSS more strictly. The odds are that your menu is
changing the style property "top" and setting it to a number. It must be
set to a length, which is a number followed by a unit. e.g. 5em.

Most likely, your menu relies on browsers' quirks modes. Fix it.

While I do appreciate your ever so helpful advice, "Fix it" dosen't do me
much good. Would you care to elaborate?

Maybe when you elaborate on how your menu works. My crystal ball isn't
working very well right now.
