XmlBeans Exception: Unexpected element: CDATA

While trying to parse an XML using xmlbeans Factory.parse(fileStream) the process generates the below Exception. There is a registered trademark symbol ® which seems to be causing the issue. If I remove the symbol and process the file, it processes and parses fine. Why would this be happening when ® is a UTF-8 character? Any help is appreciated!
